1. Introduction

Welcome to Chicken Road! These Terms of Service ("Terms") govern your access to and use of the Chicken Road mobile game application ("Game"), website, and services (collectively, the "Services") operated by Chicken Road Game Studios ("we," "us," or "our"). By downloading, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Services.

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the date at the top of these Terms and by maintaining a current version of the Terms at our website. Your continued use of our Services after such notice constitutes your acceptance of the changes.

2. Eligibility

You must be at least 13 years old to use our Services. By using our Services, you represent and warrant that you meet this requirement. If you are under the age of 18, you represent that you have your parent's or legal guardian's permission to use the Services and that your parent or legal guardian has read and agreed to these Terms on your behalf.

Though we have no obligation to screen, edit, or monitor User Content, we reserve the right to remove or disable access to any User Content for any reason, including where the User Content violates these Terms or applicable law.

5. Virtual Goods and Currency

The Game may include a virtual economy with virtual currency and goods that can be purchased with real money or earned through gameplay. Virtual currency and goods have no real-world value and cannot be exchanged for real money, goods, or services. Your purchase of virtual currency or goods grants you a limited, non-transferable, revocable license to use those items within the Game only.

All purchases are final and non-refundable, except as required by applicable law. We reserve the right to manage, regulate, control, modify, or eliminate virtual currency or goods at any time, with or without notice. We have no liability to you or any third party if we exercise such rights.

6. Intellectual Property Rights

The Services, including all content, features, and functionality, are owned by us, our licensors, or other providers and are protected by copyright, trademark, patent, and other intellectual property or proprietary rights laws. You agree not to copy, modify, create derivative works of, publicly display, publicly perform, republish, download, or distribute any of the material on our Services without our prior written consent.

The Chicken Road name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Chicken Road Game Studios or its affiliates or licensors. You must not use such marks without our prior written permission.

  • Use the Services in any manner that could disable, overburden, damage, or impair the Services
  • Use any robot, spider, or other automatic device, process, or means to access the Services for any purpose
  • Use any manual process to monitor or copy any of the material on the Services
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other malicious code
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services
  • Attempt to circumvent any technological measure implemented to restrict access to or use of the Services
  • Develop, distribute, or publicly inform other members of "auto" software programs, "macro" software programs, or other "cheat utility" software programs

We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the federal or state courts located in the United States, and you consent to the personal jurisdiction of such courts.

12. Termination

We may terminate or suspend your account or access to parts of the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will cease immediately.
